<p>We are writing to you as concerned civil society groups and trade unions from member states of the Energy Charter Conference, which will hold its annual meeting in Brussels over the next two days (10-11 December 2019). A first negotiation round to modernise the Energy Charter Treaty (ECT) will take place on 11 December.</p>
<p><span id="more-145165"></span></p>
<p>We – 278 environmental, climate, consumer, development, and trade related civil society groups, as well as trade unions – believe that the ECT is incompatible with the implementation of the Paris Climate Agreement, just transition policies developed together with workers and their unions, and other necessary public policy measures. The ECT has been – and will increasingly be – used by fossil fuel and nuclear energy companies to challenge government decisions to phase out such energy sources. It can also be an obstacle to prioritising investment in renewable energy and energy efficiency, to bringing energy production under public control, and to taking measures to end energy poverty. The ECT in its current form is outdated and a threat to the public interest.</p>
<p>We therefore call on you to ensure that the ECT can no longer undermine action to avoid climate breakdown, protect the environment, and make energy affordable for all. We also call on you to immediately halt the geographic expansion of the ECT to even more signatory states.</p>
<p>The ECT includes many rules – including on energy transit and trade – but the provisions protecting foreign energy investments are of particular concern. They allow foreign investors in the energy sector to directly sue ECT signatory states outside of existing courts, in secretive international tribunals consisting of three private lawyers. In these tribunals investors can claim dizzying sums of public money in compensation for government actions that they argue have affected their profits.</p>
<p>We identify six key problems with the ECT:</p>
<ol>
<li><strong>The ECT protects fossil fuel investments and infrastructure, and is used to challenge and undermine necessary climate action</strong>. Since 2017, the UK company Rockhopper has been suing Italy over a ban on new oil and gas operations near the country’s coast, claiming up to $350 million in compensation;<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn1\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref1\">[1]</a> in 2017, Canadian company Vermilion threatened to sue France over a proposed law to end fossil fuel extraction, which was then significantly weakened;<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn2\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref2\">[2]</a> and in autumn 2019, German company Uniper announced that it would sue the Netherlands and claim compensation if the country approved a law to phase out coal-fired power plants.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn3\" name=\"_ednref3\">[3]</a> We are likely to see more ECT lawsuits against climate action in the future as governments start to develop plans for climate neutrality and a clean energy transition. There is a real risk of so called ‘regulatory chill’, where governments are discouraged from taking action when faced with massive compensation claims.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn4\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref4\">[4]</a></li>
<li><strong>The ECT puts public budgets and taxpayers’ money at incalculable risk</strong>. Private tribunals can force states to pay out billions to compensate investors, including for entirely hypothetical missed ‘future profits’ that are not compensatable under national or EU law. Under the ECT, governments have already been ordered or agreed to pay a total of more than US$51.6 billion in damages from the public purse.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn5\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref5\">[5]</a></li>
<li><strong>The ECT could threaten the promotion of renewable energy</strong>. The ECT creates a risk for those regulators who discriminate between different sources of energy.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn6\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref6\">[6]</a> This could deter governments from taking urgently-needed measures to favour renewable energy at the expense of carbon-intensive investments. In addition, the ECT neither protects investments in energy efficiency, nor other measures to reduce energy demand.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn7\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref7\">[7]</a></li>
<li><strong>The ECT can undermine environmental protection</strong>. One example is Swedish company Vattenfall’s €1.4 billion ECT legal attack from 2009 on environmental standards for a coal-fired power plant in Germany. According to officials, the amount at stake forced the local government to weaken the regulations and settle the case, exacerbating the environmental impacts that the plant will have on the local river and its wildlife.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn8\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref8\">[8]</a> In Vattenfall’s second and ongoing ECT suit against Germany, the company is claiming €6.1 billion for the country’s accelerated nuclear exit following the Fukushima disaster.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn9\" name=\"_ednref9\">[9]</a> In November 2019, Australian company Aura Energy put Sweden on notice of an ECT dispute over the country’s 2018 decision to ban uranium mining over environmental and health concerns.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn10\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref10\">[10]</a></li>
<li><strong>The ECT can be used to attack measures to make energy affordable and put it under public control</strong>. Several Eastern European countries have been sued under the ECT because they took steps to curb big energy’s profits and to lower electricity prices for consumers.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn11\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref11\">[11]</a> ECT provisions can also be used against initiatives to bring energy production and services under public, democratic ownership and control, and reverse the negative impacts of failed energy privatisations.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn12\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref12\">[12]</a></li>
<li><strong>Investor-state arbitration under the ECT is at odds with the rule of law and undermines domestic legal systems</strong>. Contrary to the principle of equal access to justice, the ECT creates a parallel justice system that is exclusively available to some of the richest and most powerful actors in society: foreign investors. ECT arbitrations are highly secretive and riddled with conflicts of interest as arbitrators earn big money with cases and have an interest in sustaining the boom in ECT disputes.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn13\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref13\">[13]</a> The European Court of Justice, through its 2018 Achmea ruling, has put into question the legality of these parallel private judicial proceedings inside the European Union.</li>
</ol>
<p>Moreover, the ECT’s investor privileges do not bring the claimed economic benefits. There is currently no evidence that the agreement helps facilitate investment to reduce energy poverty, let alone investment into renewable energy.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn14\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref14\">[14]</a></p>
<p>As it stands, the modernisation process is unlikely to fix these failures. The EU’s mandate for the negotiations, for example, does not foresee an end to investment protection for fossil fuels, nor an exclusion of investment arbitration or other types of investor-state dispute settlement from the ECT.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn15\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref15\">[15]</a> Any changes to the ECT to make it compatible with the Paris Agreement would have to be agreed unanimously by all its members, many of whom are key fossil fuel producing or trading countries. Some members have already stated that they see no need to revise the ECT at all.<a href=\"https://www.energy-charter-dirty-secrets.org/open-letter/#_edn16\" target=\"_blank\" rel=\"noopener noreferrer\" name=\"_ednref16\">[16]</a></p>
<p>We therefore call on you to:</p>
<ul>
<li>Include as a condition for entering negotiations to modernise the ECT the <strong>removal of provisions that protect fossil fuels</strong>;</li>
<li>Request the <strong>removal of investor-state dispute settlement</strong> provisions from the agreement;</li>
<li><strong>Withdraw from or jointly terminate the ECT</strong>, if the modernisation process fails to promptly make the agreement climate- and environment-proof by removing investor-state dispute settlement and protections for fossil fuels;</li>
<li>Immediately <strong>put a brake on the process to expand the ECT</strong> geographically to ever new states and to not allow any treaty accessions as long as the ECT is in its current state.</li>

The revocation came after ČEZ had cut off power to the water and sanitation utilities of several Albanian towns, accumulated considerable outstanding debts to the government, and failed to meet other contractual obligations, for example, reducing energy losses and investing in the power grid. Albanians had also complained about high prices, poor service or even an absence of it, as well as power shut-downs. In addition ČEZ had faced fraud investigations by Tirana’s prosecution office including for issuing fake fines to both real and fictive customers in order to drive up its alleged losses on paper and get price hikes approved by the Albanian regulators. Albania settled the case in 2014 and agreed to pay €100 million in damages. <p>We are writing to you as concerned civil society groups and trade unions from member states of the Energy Charter Conference, which will hold its annual meeting in Brussels over the next two days (10-11 December 2019). A first negotiation round to modernise the Energy Charter Treaty (ECT) will take place on 11 December.</p>
<p><span id="more-132575"></span></p>
<p>We – 278 environmental, climate, consumer, development, and trade related civil society groups, as well as trade unions – believe that the ECT is incompatible with the implementation of the Paris Climate Agreement, just transition policies developed together with workers and their unions, and other necessary public policy measures. The ECT has been – and will increasingly be – used by fossil fuel and nuclear energy companies to challenge government decisions to phase out such energy sources. It can also be an obstacle to prioritising investment in renewable energy and energy efficiency, to bringing energy production under public control, and to taking measures to end energy poverty. The ECT in its current form is outdated and a threat to the public interest.</p>
<p>We therefore call on you to ensure that the ECT can no longer undermine action to avoid climate breakdown, protect the environment, and make energy affordable for all. We also call on you to immediately halt the geographic expansion of the ECT to even more signatory states.</p>
<p>The ECT includes many rules – including on energy transit and trade – but the provisions protecting foreign energy investments are of particular concern. They allow foreign investors in the energy sector to directly sue ECT signatory states outside of existing courts, in secretive international tribunals consisting of three private lawyers. In these tribunals investors can claim dizzying sums of public money in compensation for government actions that they argue have affected their profits.</p>
<p>We identify six key problems with the ECT:</p>
<ol>
<li><strong>The ECT protects fossil fuel investments and infrastructure, and is used to challenge and undermine necessary climate action</strong>. Since 2017, the UK company Rockhopper has been suing Italy over a ban on new oil and gas operations near the country’s coast, claiming up to $350 million in compensation;<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn1" target="_blank" rel="noopener noreferrer" name="_ednref1">[1]</a> in 2017, Canadian company Vermilion threatened to sue France over a proposed law to end fossil fuel extraction, which was then significantly weakened;<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn2" target="_blank" rel="noopener noreferrer" name="_ednref2">[2]</a> and in autumn 2019, German company Uniper announced that it would sue the Netherlands and claim compensation if the country approved a law to phase out coal-fired power plants.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn3" name="_ednref3">[3]</a> We are likely to see more ECT lawsuits against climate action in the future as governments start to develop plans for climate neutrality and a clean energy transition. There is a real risk of so called ‘regulatory chill’, where governments are discouraged from taking action when faced with massive compensation claims.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn4" target="_blank" rel="noopener noreferrer" name="_ednref4">[4]</a></li>
<li><strong>The ECT puts public budgets and taxpayers’ money at incalculable risk</strong>. Private tribunals can force states to pay out billions to compensate investors, including for entirely hypothetical missed ‘future profits’ that are not compensatable under national or EU law. Under the ECT, governments have already been ordered or agreed to pay a total of more than US$51.6 billion in damages from the public purse.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn5" target="_blank" rel="noopener noreferrer" name="_ednref5">[5]</a></li>
<li><strong>The ECT could threaten the promotion of renewable energy</strong>. The ECT creates a risk for those regulators who discriminate between different sources of energy.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn6" target="_blank" rel="noopener noreferrer" name="_ednref6">[6]</a> This could deter governments from taking urgently-needed measures to favour renewable energy at the expense of carbon-intensive investments. In addition, the ECT neither protects investments in energy efficiency, nor other measures to reduce energy demand.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn7" target="_blank" rel="noopener noreferrer" name="_ednref7">[7]</a></li>
<li><strong>The ECT can undermine environmental protection</strong>. One example is Swedish company Vattenfall’s €1.4 billion ECT legal attack from 2009 on environmental standards for a coal-fired power plant in Germany. According to officials, the amount at stake forced the local government to weaken the regulations and settle the case, exacerbating the environmental impacts that the plant will have on the local river and its wildlife.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn8" target="_blank" rel="noopener noreferrer" name="_ednref8">[8]</a> In Vattenfall’s second and ongoing ECT suit against Germany, the company is claiming €6.1 billion for the country’s accelerated nuclear exit following the Fukushima disaster.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn9" name="_ednref9">[9]</a> In November 2019, Australian company Aura Energy put Sweden on notice of an ECT dispute over the country’s 2018 decision to ban uranium mining over environmental and health concerns.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn10" target="_blank" rel="noopener noreferrer" name="_ednref10">[10]</a></li>
<li><strong>The ECT can be used to attack measures to make energy affordable and put it under public control</strong>. Several Eastern European countries have been sued under the ECT because they took steps to curb big energy’s profits and to lower electricity prices for consumers.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn11" target="_blank" rel="noopener noreferrer" name="_ednref11">[11]</a> ECT provisions can also be used against initiatives to bring energy production and services under public, democratic ownership and control, and reverse the negative impacts of failed energy privatisations.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn12" target="_blank" rel="noopener noreferrer" name="_ednref12">[12]</a></li>
<li><strong>Investor-state arbitration under the ECT is at odds with the rule of law and undermines domestic legal systems</strong>. Contrary to the principle of equal access to justice, the ECT creates a parallel justice system that is exclusively available to some of the richest and most powerful actors in society: foreign investors. ECT arbitrations are highly secretive and riddled with conflicts of interest as arbitrators earn big money with cases and have an interest in sustaining the boom in ECT disputes.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn13" target="_blank" rel="noopener noreferrer" name="_ednref13">[13]</a> The European Court of Justice, through its 2018 Achmea ruling, has put into question the legality of these parallel private judicial proceedings inside the European Union.</li>
</ol>
<p>Moreover, the ECT’s investor privileges do not bring the claimed economic benefits. There is currently no evidence that the agreement helps facilitate investment to reduce energy poverty, let alone investment into renewable energy.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn14" target="_blank" rel="noopener noreferrer" name="_ednref14">[14]</a></p>
<p>As it stands, the modernisation process is unlikely to fix these failures. The EU’s mandate for the negotiations, for example, does not foresee an end to investment protection for fossil fuels, nor an exclusion of investment arbitration or other types of investor-state dispute settlement from the ECT.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn15" target="_blank" rel="noopener noreferrer" name="_ednref15">[15]</a> Any changes to the ECT to make it compatible with the Paris Agreement would have to be agreed unanimously by all its members, many of whom are key fossil fuel producing or trading countries. Some members have already stated that they see no need to revise the ECT at all.<a href="https://www.energy-charter-dirty-secrets.org/open-letter/#_edn16" target="_blank" rel="noopener noreferrer" name="_ednref16">[16]</a></p>
<p>We therefore call on you to:</p>
<ul>
<li>Include as a condition for entering negotiations to modernise the ECT the <strong>removal of provisions that protect fossil fuels</strong>;</li>
<li>Request the <strong>removal of investor-state dispute settlement</strong> provisions from the agreement;</li>
<li><strong>Withdraw from or jointly terminate the ECT</strong>, if the modernisation process fails to promptly make the agreement climate- and environment-proof by removing investor-state dispute settlement and protections for fossil fuels;</li>
<li>Immediately <strong>put a brake on the process to expand the ECT</strong> geographically to ever new states and to not allow any treaty accessions as long as the ECT is in its current state.</li>

The revocation came after ČEZ had cut off power to the water and sanitation utilities of several Albanian towns, accumulated considerable outstanding debts to the government, and failed to meet other contractual obligations, for example, reducing energy losses and investing in the power grid. Albanians had also complained about high prices, poor service or even an absence of it, as well as power shut-downs. In addition ČEZ had faced fraud investigations by Tirana’s prosecution office including for issuing fake fines to both real and fictive customers in order to drive up its alleged losses on paper and get price hikes approved by the Albanian regulators. Albania settled the case in 2014 and agreed to pay €100 million in damages. 										<content:encoded><![CDATA[<p><i>Sciences Citoyennes a signé une tribune aux côtés de 140 organisations appelant à La Marche du siècle pour le climat. Nous appelons à rejoindre les étudiants et élèves de France et du monde qui feront grève pour le climat le vendredi 15 mars, et à marcher le samedi 16 mars pour demander des changements radicaux pour répondre à l&rsquo;urgence climatique. </i></p>

<p>La Marche du siècle</p>
<p>Notre contestation a éclos à l’automne. En hiver, sa croissance a été historique. Au printemps, elle change d’échelle. Il n’y a plus de saisons.</p>
<p>Nous sommes aujourd’hui des millions, prêt·es à résister, à déployer les alternatives, à demander des comptes au gouvernement, aux multinationales, aux banques et aux institutions financières.</p>
<p>Il est temps de changer de système industriel, politique et économique, pour protéger l’environnement, la société et les individus.</p>
<p><span id="more-109160"></span></p>
<p>Nous devons réduire drastiquement les émissions de gaz à effet de serre dès maintenant pour limiter le réchauffement global à 1,5°C. Nous devons préserver la biodiversité, alors que nous vivons une sixième extinction de masse. Nous devons renouveler la démocratie et contraindre les décideurs et décideuses à protéger les intérêts de toutes et tous plutôt que ceux de quelques un·es. Nous devons répartir les richesses pour obtenir la justice sociale, afin de garantir une existence digne pour chacun·e. Fin du monde et fin du mois relèvent du même combat.</p>
<p>Nous voulons combattre les dérèglements climatiques, nous voulons combattre la violence sociale et nous refusons toute forme de répression ou de discrimination.</p>
<p>Se déplacer, se nourrir, se loger, se chauffer, produire, consommer autrement est possible : autant de propositions alternatives que les décideurs politiques et économiques retardent et empêchent au nom d&rsquo;intérêts particuliers qui nous conduisent dans le mur.</p>
<p>Notre printemps sera climatique et social. Le 15 mars, la jeunesse sera en grève partout en France et dans le monde. Le 16 mars, nous marcherons ensemble, pour dire « ça suffit ! » et demander des changements immédiats.</p>

										<content:encoded><![CDATA[<p>Lors de la quatrième session de l\&rsquo;Assemblée des Nations Unies pour l\&rsquo;Environnement (UNEA-4), qui se tiendra à Nairobi, Kenya, du 11 au 15 mars 2019, une proposition de résolution sur la gouvernance globale de la géo-ingénierie* est mise à l\&rsquo;agenda par la Suisse, et soutenue par le Burkina Faso, les États Fédérés de Micronésie, le Mali, le Mexique et le Niger.</p>
<p>À l’appel de l’ONG ETC Group**, l’association Sciences Citoyennes vous demande d\&rsquo;exprimer une opposition ferme aux tentatives agressives de légitimer la géo-ingénierie comme réponse aux changements climatiques en interpellant le ministre de la Transition écologique et solidaire, François de Rugy <span id="more-145153"></span>(voir plus bas).</p>
<p>Les intérêts et investissements importants des industries fossiles pour les technologies de géo-ingénierie laissent peu de doutes sur le fait que la géo-ingénierie soit loin d\&rsquo;être une solution, mais bien plus une menace de s\&rsquo;enfoncer un peu plus dans une économie toujours plus dépendante aux énergies fossiles.</p>
<p>Si au demeurant une évaluation des risques et impacts associés aux technologies de géo-ingénierie devait être considérée par l\&rsquo;Assemblée des Nations Unies pour l\&rsquo;Environnement, il deviendrait crucial que la composition du comité ou groupe chargé de cette mission ne soit pas restreinte aux seuls experts scientifiques, mais qu\&rsquo;elle inclue des représentants indépendants de la société civile, des peuples autochtones, des paysans, la jeunesse, ainsi que des communautés possiblement affectées. Les personnes ou organisations ayant des intérêts directs ou commerciaux à la géo-ingénierie devront être exclues de cette composition. Il est essentiel qu\&rsquo;une politique forte concernant les conflits d\&rsquo;intérêts soit adoptée afin de protéger l\&rsquo;intégrité du processus et les résultats de l\&rsquo;évaluation de la géo-ingénierie sous l\&rsquo;égide de l\&rsquo;Assemblée.</p>

<p>Lors de la quatrième session de l\&rsquo;Assemblée des Nations Unies pour l\&rsquo;Environnement (UNEA-4), qui se tiendra à Nairobi, Kenya, du 11 au 15 mars 2019, une proposition de résolution sur la gouvernance globale de la géo-ingénierie est mise à l\&rsquo;agenda par la Suisse, et soutenue par le Burkina Faso, les États Fédérés de Micronésie, le Mali, le Mexique et le Niger.<span id="more-145152"></span></p>
<p>Le terme géo-ingénierie désigne les technologies d\&rsquo;intervention à large échelle sur les océans, les sols et l\&rsquo;atmosphère terrestre dans le but d\&rsquo;atténuer certains des symptômes des dérèglements climatiques. Le terme comprend deux grandes catégories de techniques : la gestion du rayonnement solaire (<em>Solar Radiation Management</em>, SRM en anglais) et la captation du dioxyde de carbone (<em>Carbon Dioxide Removal</em>, CDR en anglais).</p>
<p>En l’état actuel des connaissances et du fait des conséquences potentielles pour l\&rsquo;ensemble de la population mondiale, l\&rsquo;association <em>Sciences Citoyennes</em> s\&rsquo;oppose fermement au déploiement et aux expérimentations des techniques de géo-ingénierie « à ciel ouvert » (en incluant les expériences marines). Nous exigeons donc un moratoire pour l\&rsquo;arrêt immédiat de toutes les expérimentations de géo-ingénierie en milieu non confiné.</p>
<p>La géo-ingénierie menace la paix et la sécurité mondiale. Certaines des technologies destinées à manipuler la météo ou le climat trouvent leur origine dans la recherche militaire et ont un potentiel réel d\&rsquo;usage à des fins guerrières. Le déploiement des techniques de gestion du rayonnement solaire, en particulier, pourrait créer un nouveau déséquilibre géopolitique mondial, en générant des positions de gagnants et de perdants dans la course à la mainmise sur le thermostat de la planète. Ces techniques sont également vivement critiquées par le fait qu\&rsquo;elles pourraient très probablement perturber les régimes de pluies, en particulier dans les régions qui souffrent déjà le plus des effets du changement climatique.</p>
<p>Les projets de captation du dioxyde de carbone, qui reposent sur des plantations à très grande échelle de monocultures d\&rsquo;arbres à croissance rapide ou de biomasse, impliquent eux aussi des effets indésirables sur l\&rsquo;usage des sols, l\&rsquo;eau, la biodiversité, les cultures vivrières traditionnelles ou encore la sécurité alimentaire. Ils présentent également l\&rsquo;effet pervers de pérenniser le secteur des énergies fossiles, alors même que les accords de Paris impliquent une transition urgente. Depuis de nombreuses années, les industries fossiles ont développé des recherches, des brevets et assuré la promotion de ces techniques de géo-ingénierie &#8211; comme par exemple la captation et le stockage géologique du CO<sub>2</sub> en sortie de centrale thermique – dans le seul but de sauvegarder le rôle dominant des énergies fossiles dans l\&rsquo;économie mondiale. Les travaux de recherche les plus récents démontrent justement comment ces techniques de géo-ingénierie pourraient paradoxalement contribuer à augmenter les émissions de CO<sub>2</sub> en nous enfermant dans des infrastructures destinées aux énergies fossiles pour les décennies à venir.</p>
<p>Indubitablement, la géo-ingénierie constitue une approche contre-productive pour répondre à la crise climatique. Nous appelons donc à une interdiction des expérimentations et du déploiement de ces techniques en milieu non confiné, ainsi qu\&rsquo;à l\&rsquo;adoption d\&rsquo;un système de gouvernance global, transparent, multilatéral, participatif et placé sous le contrôle des Nations Unies. Le moratoire <em>de facto</em> sur la géo-ingénierie adopté par la Convention sur la Diversité Biologique en 2010 ou l\&rsquo;interdiction de la géo-ingénierie marine par le Protocole de Londres constituent une base pour de futures discussions de gouvernance de la géo-ingénierie sous l\&rsquo;égide des Nations Unies.</p>
<p>Au cours de la quatrième session de l\&rsquo;Assemblée des Nations Unies pour l\&rsquo;Environnement, nous vous demandons d\&rsquo;exprimer une opposition ferme aux tentatives agressives de légitimer la géo-ingénierie comme réponse aux changements climatiques. Les intérêts et investissements importants des industries fossiles pour les technologies de géo-ingénierie laissent peu de doutes sur le fait que la géo-ingénierie soit loin d\&rsquo;être une solution, mais bien plus une menace de s\&rsquo;enfoncer un peu plus dans une économie toujours plus dépendante aux énergies fossiles. Si au demeurant une évaluation des risques et impacts associés aux technologies de géo-ingénierie devait être considérée par l\&rsquo;Assemblée des Nations Unies pour l\&rsquo;Environnement, il deviendrait crucial que la composition du comité ou groupe chargé de cette mission ne soit pas restreinte aux seuls experts scientifiques, mais qu\&rsquo;elle inclue des représentants indépendants de la société civile, des peuples autochtones, des paysans, la jeunesse, ainsi que des communautés possiblement affectées. Les personnes ou organisations ayant des intérêts directs ou commerciaux à la géo-ingénierie devront être exclues de cette composition. Il est essentiel qu\&rsquo;une politique forte concernant les conflits d\&rsquo;intérêts soit adoptée afin de protéger l\&rsquo;intégrité du processus et les résultats de l\&rsquo;évaluation de la géo-ingénierie sous l\&rsquo;égide de l\&rsquo;Assemblée.</p>
<p>Cette demande est partagée par plus de 200 organisations, ONG et mouvements populaires à travers le globe qui ont rejoint la campagne H.O.M.E. (<em>Hands Off Mother Earth</em> &#8211; Ne touchez pas à Mère Nature)<a href=\"#_ftn1\" name=\"_ftnref1\">[1]</a>. 										<content:encoded><![CDATA[<p>Dans le cadre des mobilisations citoyennes en marge de la <strong>COP21</strong> (21<sup>e</sup> Conférence des parties de la Convention-cadre des Nations unies sur les changements climatiques) en 2015, <strong>Sciences Citoyennes</strong> a décidé de s&#8217;emparer de la question de la <strong>géo-ingénierie</strong>. Depuis nous participons à l&rsquo;acculturation sur ces techniques controversées.<span id="more-26735"></span></p>
<p><strong>Sciences Citoyennes</strong> a pris le parti de multiplier les formes et les canaux de diffusion pour que chacun et chacune puissent appréhender le sujet de la <strong>manipulation du climat à grande échelle</strong>.</p>

<p>Dans le rapport publié en 2014 par le Giec, les techniques de manipulation à grande échelle (géo-ingénierie) faisaient leur apparition sous la forme d’un plan B laissant entrevoir une place pour les apprentis sorciers du climat. Si le récent rapport du Giec a écarté l’usage de techniques inquiétantes liées à la gestion du rayonnement solaire, il laisse néanmoins une place considérable aux « technologies à émissions négatives », un oxymore regroupant des techniques variées de captations du CO<sub>2</sub> et présentes dans 4 scénarios sur 5 envisagés par les experts. Le recours massif à des technologies à émissions négatives aurait des répercussions certaines et, à coup sûr, inégalitaires à différents endroits de la planète, que ce soit sur l’usage des sols, la production alimentaire ou la biodiversité. Le « petit précis » accessible ci-dessous fait le point sur ces questions.</p>

<p>Dans un <a class="mtli_attachment mtli_pdf" href="http://www.geoengineeringmonitor.org/wp-content/uploads/2018/10/HOME_manifesto-FR.pdf" rel="mtli_filesize58kB">Manifeste</a> ayant reçu un grand appui et qui a été diffusé aujourd’hui, 23 organisations internationales, 6 récipiendaires du prix Nobel alternatif et 87 organisations nationales provenant de 5 continents ont appelé à un arrêt des tests et à la prise en compte des effets politiques de la géo-ingénierie climatique. Parmi les signataires figurent notamment des mouvements issus des peuples autochtones, des agriculteurs ainsi que des réseaux se consacrant à la justice climatique et à la protection de l’environnement.</p>
<p><span id="more-100771"></span>Le Manifeste a été diffusé en même temps que la rencontre du Groupe d’experts intergouvernemental sur l’évolution du climat (GIEC) en Corée du Sud, laquelle visait à débattre du nouveau rapport portant sur la manière de limiter le réchauffement climatique à 1.5 degrés Celsius. Plusieurs prédisent que le rapport va promouvoir l’usage controversé et non-éprouvé de techniques de géo-ingénierie climatique.</p>
<p>La géo-ingénierie climatique fait référence à une série de solutions techniques et théoriques s’appliquant à grande échelle et visant à réduire les changements climatiques, ce qui pourrait avoir des effets dévastateurs sur l’environnement, les écosystèmes et les communautés du monde entier. Les défenseurs de ces pratiques affirment que la géo-ingénierie atténuerait les symptômes du changement climatique en abaissant les températures de la Terre soit en bloquant une partie des rayons du soleil ou en réfléchissant la lumière du soleil dans l’espace, ou encore en capturant le dioxyde de carbone dans l’atmosphère pour le stocker indéfiniment sous terre ou dans les océans.</p>
<p>Le concept est largement promu par un petit groupe de gouvernements, de corporations et de scientifiques parmi les pays les plus puissants et les plus polluants, lesquels ont mené la recherche dans le domaine de la géo-ingénierie ainsi que le lobbying afin de faire de la géo-ingénierie la réponse politique au changement climatique, menant plus récemment à des expériences à ciel ouvert pour tester ces technologies.</p>
<p>Les signataires du manifeste contestent les bénéfices proclamés issus de la géo-ingénierie et souhaitent mettre en évidence le grand risque posé par ces technologies, dont le fait que leur déploiement pourrait empirer les impacts des changements climatiques. Les signataires appellent à :</p>
<ul>
<li>Bannir toutes les expériences de géo-ingénierie et leur déploiement.</li>
<li>Un arrêt de toutes les expériences en plein air, y compris: le projet SCoPEx à Tucson, en Arizona, qui propose d’injecter des particules de sulfate et d’autres matériaux dans l’atmosphère pour tester leur efficacité à bloquer le soleil; le projet Ice911 en Alaska, qui viserait à disperser des millions de minuscules bulles de verre sur la glace arctique pour ralentir la fonte et réfléchir la lumière du soleil; le Marine Cloud Brightening Project à Monterey Bay en Californie, qui injecterait de l’eau salée dans les nuages pour les blanchir et réfléchir la lumière du soleil; et le projet de fertilisation des océans Oceanos au Chili. Les trois expériences américaines sont planifiées sur des territoires autochtones ancestraux et traditionnels.</li>
<li>Un arrêt de tous les projets de séquestration géologique du dioxyde de carbone et du captage direct de l’air à grande échelle, car ils perpétuent l’extraction et la combustion de combustibles fossiles, et l’arrêt de tous les projets de bioénergie avec captage et stockage du carbone, qui en plus d’être non prouvés et techniquement irréalisables auraient de graves conséquences sur l’utilisation des terres, la sécurité alimentaire, l’environnement et la biodiversité.</li>
<li>Soutenir la diversité des solutions pour répondre au changement climatique, solutions déjà éprouvées et moins risquées, mais qui restent marginalisées dans les délibérations sur le changement climatique.</li>
</ul>
<p>Le mouvement contre la géo-ingénierie est né en 2010, lorsque plus de 35 000 organisations et mouvements populaires pour la justice climatique se sont réunis à la Conférence mondiale des peuples sur le changement climatique et les droits de la Terre Mère à Cochabamba, Bolivie, et ont déclaré leur opposition à la géo-ingénierie, lançant la campagne  » Hands Off Mother Earth  » (HOME Campaign) contre la géo-ingénierie. Le mois dernier, à San Francisco, à l’occasion de la Semaine de la solidarité pour des solutions (Solidarity to Solution Week) consacrée aux solutions locales aux changements climatiques, une vaste alliance, dont l’Alliance pour la justice climatique et le Réseau environnemental autochtone, a promis d’amplifier et de revigorer la campagne HOME. Cela a été jugé essentiel en raison de la présence croissante de la géo-ingénierie climatique dans les négociations et parmi les universitaires, y compris les propositions d’essais en plein air des technologies. Une nouvelle impulsion a été donné au mouvement international pour stopper la géo-ingénierie et être solidaire des communautés et des organisations qui résistent aux expériences de géo-ingénierie.</p>

<p>À l&rsquo;initiative d&rsquo;Attac et de la Fondation Copernic, syndicalistes, responsables associatifs et politiques, chercheur·es, universitaires ou artistes appellent à manifester pacifiquement dans la rue massivement le 8&nbsp;décembre, journée de mobilisation internationale pour la justice climatique, en convergence avec la quatrième journée de mobilisation des gilets jaunes.<br />

Le mouvement des gilets jaunes met dans le débat public l’ensemble de la politique sociale du gouvernement. Plus largement ce sont les politiques néolibérales mises en œuvre par les gouvernements successifs depuis des décennies qui sont en cause. Fins de mois de plus en plus difficiles, précarisation toujours accrue du travail, injustice fiscale, logements chers, conditions de vie qui se détériorent, telle est la situation subie par la majorité de la population. Ce qui touche en particulier les femmes, très nombreuses à se mobiliser dans ce mouvement. Dans le même temps, l’évasion fiscale n’a jamais été aussi importante et les plus riches se sont vu offrir de multiples allègements d’impôts&nbsp;: suppression de l’ISF, flat tax de 30&nbsp;% pour les revenus du capital qui ne sont plus soumis à l’impôt progressif, baisse de l’impôt sur les sociétés… Dans ces conditions, l’augmentation des taxes sur les carburants est apparue comme «la goutte d’eau qui a fait déborder le vase».</p>
<p>En dépit d’une tentative de mainmise de l’extrême droite sur le mouvement, celui-ci se caractérise par son auto-organisation horizontale et pose l’exigence d’une démocratie réelle contre une présidence autoritaire et méprisante. A l’heure où se déroule la COP&nbsp;24 en Pologne et où la lutte contre le réchauffement climatique est urgente, ce mouvement met également en évidence le lien entre la question sociale et les impératifs écologiques&nbsp;: les plus grands pollueurs sont exonérés de tout effort, les principales causes du réchauffement climatique ne sont pas traitées, la casse des services publics et des commerces de proximité et l’étalement urbain se poursuivent, les alternatives en matière de transport en commun ne sont pas développées. Le modèle du logement social en France est en mis en péril par sa marchandisation au profit des grands groupes privés. Dans ces conditions, ce n’est certainement pas aux classes moyennes et populaires de payer la transition écologique.</p>
<p>La politique du gouvernement ne répond ni à la colère sociale ni aux impératifs écologiques. Le gouvernement laisse les multinationales et les lobbys productivistes n’en faire qu’à leur tête en privilégiant toujours plus leur intérêt propre et celui de leurs actionnaires au détriment du plus grand nombre et de l’avenir de la planète. Pendant des jours, le gouvernement a campé sur une posture intransigeante, refusant le moindre geste et clamant qu’il maintenait le cap et ce, malgré le fait qu’une énorme majorité de la population soutenait ce mouvement. Cette attitude a entraîné une exaspération croissante qui a conduit à des actes de violence dont le gouvernement pouvait espérer tirer parti. Cela n’a pas été le cas et le soutien de la population est resté massif.</p>
<p>Le gouvernement vient d’annoncer, entre autres, le gel, puis l’annulation de l’augmentation des taxes sur les carburants. C’est un premier recul mais c’est trop peu, trop tard, car c’est de toute la politique sociale et de ses conséquences économiques et écologiques qu’il faut discuter. Alors même que la jeunesse a décidé de se mettre en mouvement pour contester les choix éducatifs du pouvoir, c’est un changement de cap qu’il faut imposer. Pour commencer, il faut répondre aux revendications syndicales en augmentant le smic et en revenant sur le plafonnement de l’augmentation des retraites à 0,3&nbsp;%, rétablir l’ISF et taxer les multinationales, dont Total, les Gafa et les banques qui financent les énergies fossiles pour investir massivement dans l’isolation thermique des bâtiments et les énergies renouvelables.</p>
<p>C’est pourquoi, les soussigné·es, syndicalistes, responsables associatifs et politiques, chercheur·es, universitaires, artistes,&nbsp;etc., soutiennent les revendications de justice fiscale et sociale portées par le mouvement des gilets jaunes. Ils appellent la population à se mobiliser pour imposer une politique qui permette de mieux vivre, et à manifester pacifiquement dans la rue massivement le 8&nbsp;décembre, journée de mobilisation internationale pour la justice climatique, en convergence avec la quatrième journée de mobilisation des gilets jaunes.</p>
