<h3>Ending Gag Lawsuits in Europe Protecting Democracy and Fundamental Rights</h3>
<p><strong>The problem: gag lawsuits against public interest defenders</strong></p>
<p>The EU must end gag lawsuits used to silence individuals and organisations that hold those in positions of power to account. Strategic Lawsuits Against Public Participation (SLAPP) are lawsuits brought forward by powerful actors (e.g. companies, public officials in their private capacity, high profile persons) to harass and silence those speaking out in the public interest. Typical victims are those with a watchdog role, for instance: journalists, activists, informal associations, academics, trade unions, media organisations and civil society organisations.<span id="more-141198"></span></p>
<p>Recent examples of SLAPPs include <a href="https://actions.sumofus.org/a/can-you-chip-in-to-help-defend-us-against-paypal">PayPal suing SumOfUs</a> for a peaceful protest outside PayPal’s German headquarters; co-owners of Malta’s <a href="https://timesofmalta.com/articles/view/satabank-owner-sues-manuel-delia-in-bulgaria.772901">Satabank suing blogger Manuel Delia</a> for a blog post denouncing money laundering at Satabank; and <a href="https://monitor.civicus.org/updates/2018/03/09/slapp-lawsuits-threaten-critical-voices-france/">Bollore Group suing Sherpa and ReAct in France</a> to stop them from reporting human rights abuses in Cameroon. In Italy <a href="https://www.rcmediafreedom.eu/Dossiers/SLAPPs-Strategic-Lawsuits-Against-Public-Participation">more than 6,000 or two-thirds of defamation lawsuits</a> filed against journalists and media outlets annually are dismissed as meritless by a judge. When Maltese journalist <a href="https://www.cjr.org/analysis/slapp-daphne-caruana-galizia-malta.php">Daphne Caruana Galizia was brutally killed, there were 47 SLAPPs pending against her</a>.</p>
<p>SLAPPs are a threat to the EU legal order, and, in particular:</p>
<ul>
<li><strong>A threat to democracy and fundamental rights</strong>. The EU is founded on the rule of law and respect for human rights. SLAPPs impair the right to freedom of expression, to public participation and to assembly of those who speak out in the public interest, and have a chilling effect on the exercise of these rights by the community at large.</li>
<li><strong>A threat to access to justice and judicial cooperation</strong>. Cross-border judicial cooperation relies on the principles of effective access to justice across the Union and mutual trust between legal systems. That trust must be based on the legally enforceable upholding of common values and minimum standards. To the extent that they distort and abuse the system of civil law remedies, SLAPPs undermine the mutual trust between EU legal systems: member states must be confident that rulings issued by other member states’ courts are not the result of abusive legal strategies and are adopted as the outcome of genuine proceedings.</li>
<li><strong>A threat to the enforcement of EU law, including in connection to the internal market and the protection of the EU budget</strong>. The effective enforcement of EU law, including the proper functioning of the internal market, depends on the scrutiny of the behaviour of individual entities by the EU, member states and – crucially – informed individuals. Watchdogs, be it media or civil society actors, play a key enforcement role. Therefore, the absence of a system which safeguards public scrutiny is a threat to the enforcement of EU law. The same reasoning applies to the management of EU programmes and budget, which cannot be monitored through the sole vigilance of the European Commission.</li>
<li><strong>A threat to freedom of movement</strong>. The absence of rules to protect watchdogs from SLAPP has an impact on the exercise of the Treaty’s fundamental freedoms, since it affects the ability of media, civil society organisations and information services providers to confidently operate in jurisdictions where the risk of SLAPPs is higher, and discourages people from working for organisations where they can be the target of SLAPPs.</li>

<p><strong>The solution: an EU set of anti-SLAPP measures</strong></p>
<p>The EU can and must end SLAPPs by adopting the following complementary measures to protect all those affected by SLAPPs:</p>
<ol>
<li><strong>An anti-SLAPP directive</strong><br />
An anti-SLAPP directive is needed to establish a Union-wide minimum standard of protection against SLAPPs, by introducing exemplary sanctions to be applied to claimants bringing abusive lawsuits, procedural safeguards for SLAPP victims, including special motions to contest the admissibility of certain claims and/or rules making the burden shifting to the plaintiff to demonstrate a reasonable probability of succeeding in such claims, as well as other types of preventive measures. The Whistle-Blower Directive sets an important precedent protecting those who report a breach of Union law in a work-related context. Now the EU must ensure a high standard of protection against gag lawsuits for everyone who speaks out – irrespective of the form and the context – in the public interest.The legal basis for an anti-SLAPP directive is to be found in multiple provisions of the Treaty; for example, Article 114 TFEU on the proper functioning of the internal market, Article 81 TFEU on judicial cooperation and effective access to justice and Article 325 TFEU on combating fraud related to EU programmes and budgets.</li>
<li><strong>The reform of Brussels I and Rome II Regulations</strong><br />
Brussels I Regulation (recast) contains rules which grant claimants the ability to choose where to make a claim. This must be amended to end forum shopping in defamation cases, which forces defendants to hire and pay for defence in countries whose legal systems are unknown to them and where they are not based. This is beyond the means of most and falls foul of the principles of fair trial and equality of arms.Rome II Regulation does not regulate which national law will apply to a defamation case. This allows claimants to select the most favourable substantive law and therefore leads to a race to the bottom. Today, victims may be subject to the lowest standard of freedom of expression applicable to their case.</li>
<li><strong>Support all victims of SLAPPs</strong><br />
Funds are needed to morally and financially support all victims of SLAPPs, especially with legal defence. Justice Programme funds should be used to train judges and practitioners, and a system to publicly name and shame the companies that engage in SLAPPs, for example in an EU register, should be created.</li>
</ol>
<p>Finally, the EU must ensure that <strong>the scope of anti-SLAPP measures include <em>everybody</em> affected by SLAPPs</strong>, including journalists, activists, trade unionists, academics, digital security researchers, human rights defenders, media and civil society organisations, among others.</p>

<p>We, civil society organisations from Germany and across Europe, demand a German EU Council Presidency that sets new standards in transparency and accountability, and which tackles the challenges ahead in the public interest.</p>
<p>The EU Presidency must prioritise three urgent challenges: handling the coronavirus pandemic and its consequences, tackling inequality, and fighting the climate crisis. These need to be addressed together on a strong foundation of democracy, anti-racism, human rights, social rights, and international solidarity. Instead of bailing out climate polluters and tax-dodgers, and giving in to ‘coronawash’ lobbying for weaker regulations, we need a new vision based on progressive alternatives that will roll back inequality. The German Presidency must use this moment to forgo corporate interests and to instead make serving the public interest the clear priority.</p>
<p><span id="more-140787"></span></p>
<p>Many voices – European civil society, Members of Parliaments of EU member states, and the European Ombudsman – have criticised the serious lack of transparency of decision-making and lobbying in the Council. The public is excluded from knowing how files progress in the Council, the positions of their governments, and which quid pro quo deals have been made. This is replicated at the national level, where there is rarely openness about how a government decides its position on an EU file. While corporate lobbyists with large resources and well-connected networks manage to have their voices heard in this process, civil society is much less visible. This results in a serious democratic deficit.</p>
<p>These issues need tackling urgently. We demand the following:</p>
<p>1. Ensure the EU Presidency is not used to champion big business over the public interest. The German Government must put an end to privileged access for corporate interests and business-only policy consultations, for its EU Presidency and beyond.</p>
<p>2. As President, Germany must champion much needed legislative and lobby transparency reforms within the Council so that citizens can follow the progress of files and the position of their member state.</p>
<p>3. Germany must also lead by example. It should provide full lobby transparency of meetings held with lobbyists by the Government, a legislative footprint, and a world class lobby register. It should also reject all corporate sponsorship of its Presidency.</p>
<p>4. Citizens should have new rights to both find out about, and have a say on, their government’s decision-making on EU matters. Citizens must no longer be excluded from this process.</p>

<p>Monsieur le Président de la République,</p>
<p>La France a adopté en 2016, avec <a href="https://www.mediapart.fr/journal/economie/140616/transparence-les-ambiguites-de-sapin-2">la Loi dite </a><a href="https://www.mediapart.fr/journal/economie/140616/transparence-les-ambiguites-de-sapin-2">Sapin 2</a>, une législation pionnière en matière de protection pour les lanceurs et lanceuses d’alerte. C’est en s’appuyant sur ses équilibres et ses acquis que nos organisations ont obtenu l’adoption en octobre dernier de la <a href="https://www.mediapart.fr/journal/international/081019/une-directive-pour-mieux-proteger-les-lanceurs-d-alerte">première </a><a href="https://www.mediapart.fr/journal/international/081019/une-directive-pour-mieux-proteger-les-lanceurs-d-alerte">directive européenne</a> en leur faveur. Cette directive reprend l’essentiel des avancées de la loi française, mais offre également une opportunité de pallier les limites de cette dernière et de l’amender. Elle comporte une « clause de non régression », qui garantit l’objectif démocratique de renforcement des protections des lanceurs d’alerte lors de sa transposition.<span id="more-130798"></span></p>
<p>Nous avons désormais deux ans maximum pour transposer la directive en droit français. Mobilisés depuis de longues années sur le sujet, nous souhaitons, du fait de l’expertise de nos structures, être partie prenante de la transposition et par conséquent être associés en amont. La transposition d’une directive est en effet un exercice de mise en œuvre politique autant que juridique, et nous tenons à ce que la France soit exemplaire en se dotant d’un des meilleurs standards de protection des lanceurs et lanceuses d’alerte dans les meilleurs délais.</p>
<p>C’est pourquoi nous souhaitons attirer votre attention sur plusieurs points.</p>
<p>En premier lieu et comme la directive le préconise, il convient de préserver les avancées de la Loi Sapin 2 et notamment une définition large du lanceur d’alerte, qui inclut le signalement des violations du droit et les menaces ou préjudices graves pour l’intérêt général. La Loi Sapin 2 a permis de simplifier le mille-feuille juridique complexe et incohérent avec des droits d’alerte variant en fonction du domaine concerné ; nous tenons à conserver le champ matériel global de la Loi Sapin 2, ainsi qu’une législation protégeant tous les lanceurs d’alerte, que leur alerte s’inscrive ou non dans le cadre professionnel.</p>
<p>Le législateur européen a tenu à aller plus loin que la loi française sur plusieurs aspects, et la directive commande de revoir notre droit national sur plusieurs points déterminants. D’abord la mise en place d’une procédure d’alerte à 2 paliers au lieu de 3 en France, permettant aux lanceurs d’alerte de choisir soit le dispositif de leur entreprise/administration soit une autorité externe (autorité judiciaire ou administrative, nationale ou européenne).</p>
<p>Des délais précis sont instaurés pour traiter l’alerte et les possibilités de révélation publique sont élargies en cas de risques de représailles, de destruction de preuves ou de conflits d’intérêts de l’autorité externe.</p>
<p>Les critères pour être reconnu et protégé comme lanceur d’alerte sont clarifiés, avec l’exigence d’être « de bonne foi » et de respecter la procédure d’alerte. Les critères subjectifs créateurs d’insécurité juridique &#8211; la nécessité d’être désintéressé et d’avoir une connaissance personnelle des faits révélés &#8211; sont écartés. Nos organisations considèrent qu’il s’agit d’une avancée, dès lors que demeure formellement exclue la rémunération des lanceurs d’alerte.</p>
<p>La directive conforte l’exerce plein et entier du droit syndical et notamment le droit de tout travailleur à être défendu et accompagné par un représentant du personnel ou un syndicat dans le cadre de cette procédure d’alerte. Elle y ajoute la possibilité pour le lanceur d’alerte d’être accompagné par un « facilitateur », collègue, élu ou encore organisation syndicale, qui pourra alors bénéficier des mêmes protections que le lanceur d’alerte. Enfin, elle prévoit, outre la réparation intégrale des dommages et l’aménagement de la charge de la preuve, un renforcement de la protection des lanceurs d’alerte avec le droit d’accéder à une assistance juridique indépendante et gratuite et la création d’une nouvelle sanction pour les auteurs de représailles.</p>
<p>Pour faire de la France une référence internationale sur le sujet et achever la rationalisation et l’effectivité de notre législation, nous souhaitons que la transposition de la directive soit aussi l’occasion d’intégrer les préconisations du Conseil de l’Europe<sup>[</sup><sup>1]</sup>.<br />
Nous proposons notamment que le statut de lanceur d’alerte soit élargi aux personnes morales, de façon à favoriser le « portage d’alerte » dans le but d’éviter d’exposer des individus fragilisés et isolés. Il nous semble également nécessaire que la définition du facilitateur soit étendue aux ONG dont la mission est l’alerte éthique, de façon que nos organisations et singulièrement la Maison des Lanceurs d’Alerte, puissent conseiller et accompagner les lanceurs d’alerte. Enfin nous préconisons le renforcement des missions et des moyens du Défenseur des droits, la création d’un fonds de soutien (abondé par les amendes) et l’octroi du droit d’asile aux lanceurs d’alerte.</p>
<p>Avec cette directive nous avons la possibilité de montrer une Europe qui protège les droits fondamentaux et garantit les libertés. C’est d’autant plus nécessaire que, comme nous le craignions, la mise en place du secret des affaires se traduit par un recul de l’information citoyenne sur l’activité des entreprises et des institutions, à l’image de l’affaire « implant files », dans laquelle des journalistes du Monde se sont vu refuser l’accès à des documents administratifs ayant trait à la santé publique au motif du secret des affaires. La transposition de cette directive est une opportunité pour construire un État exemplaire, qui lutte activement contre la corruption et toute atteinte à l’intérêt général, en garantissant aux citoyens les droits et moyens de s’informer et d’agir.</p>
<p>Nous veillerons à ce que cette transposition soit rapide et à la hauteur de ces enjeux.</p>

<p>Ce second workshop portera sur les Indicateurs-Clés de Performance en lien avec les actions contre le changement climatique. Les six régions pilotes TeRRIFICA en Allemagne, Biélorussie, Espagne, France, Pologne et Serbie seront présentes autour de thématiques communes: air, agriculture, eau et température.</p>
<p>Ce workshop est organisé par le Center for the Promotion of Science dans le cadre du projet H2020, TeRRIFICA, dans lequel huit organisations européennes travaillent ensemble pour favoriser les actions d\&rsquo;atténuation et d\&rsquo;adaptation au changement climatique dans différentes régions européennes, avec un prisme par la Recherche et l\&rsquo;Innovation Responsable.</p>

<p>After a successful <a href=\"https://terrifica.eu/europe-defies-climate-change-kick-off-meeting-of-the-terrifica-project/\" target=\"_blank\" rel=\"noopener noreferrer\">1st TeRRIFICA Reflective Workshop</a>, TeRRIFICA will hold the <strong>2nd TeRRIFICA Reflective Workshop at theNational Assembly of the Republic of Serbia on July 10th and 11th.</strong></p>

<p>This workshop is part of the <a href=\"https://eu.cpn.rs/en/science-meets-parliaments/\" target=\"_blank\" rel=\"noopener noreferrer\">‘Science Meets Parliaments’</a> event organized for the first time in Serbia by the Center for the Promotion of Science in collaboration with the Ministry of Education, Science and Technological Development, and under the patronage of the Joint Research Centrе(JRC) of the European Committee.</p>

<p>This second workshop will focus on <strong>Key Performance Indicators (KPIs) </strong>and its meaning for climate action. In this workshop, we will prove for stakeholder perspectives onwhat ‘sucess’ looks like for this kind of initiative in as much details as possible. Theworkshop will be facilitated in a manner similar to the first reflective workshop, as a series of concurrent focus groups with partner representatives as moderators. The discussions will be used as data pool for the identification of potential indicators that</p>

<p>are not already accounted for in the MoRRI indicators or other existing metrics considered for use in the project. This discussion will be analysed systematically to identify additional variables and KPIs that could be defined based on this bottom-up perspective from stakeholders. Representatives from the consortium institutions, together with members of the TeRRIFICA Advisory Boards, will gather in the premises of the Center for the Promotion of Science in Belgrade.</p>
<h4><strong>What is MoRRI?</strong></h4>
<p>MoRRI is EC-funded project that developed a monitoring system to show the evolution and benefits of RRI across EU member states. MoRRI</p>
<p>focused on the EC conception of RRI (namely an operational package consisting of six dimensions: gender equality, science literacy and science education, open access, public engagement, ethics and governance). In and across these dimensions MoRRI identified a number of monitoring indicators. This was achieved through workshops, multiple surveys, and a series of case studies alongside desk-based research and othermethods. The MoRRI project’s outputs are a significant source of evidence on the benefits of all aspects of RRI for society, the economy and science itself.</p>

<p>“Climate change is the defining challenge of our time. Mitigating its impacts and adapting to changes already taking place or impossible to avoid will require fundamental changes to societies and behaviours all over the world – as well as scientific breakthroughs, both technological and social” (Climate Change Adaptation &#8211; Directorate-General for Research and Innovation, European Commission). It is in this context the TeRRIFICA project emerges and organizes its 1stTeRRIFICA Online Conference. How can people have an impact on climate adaptation and mitigation? How can co-creation and participatory methodologies be implemented into climate action? These and other questions will be discussed during the event.</p>
<p>The Conference will start with the expert talk on co-creation given by <a href="https://www.research.manchester.ac.uk/portal/angela.connelly-2.html" target="_blank" rel="noopener noreferrer">Dr. Angela Connelly</a> (University of Manchester). Her work relates to climate change adaptation, particularly around the understanding climate risk and the opportunities and constraints offered by new technologies. She works in a co-creative manner with other disciplines and local and national policymakers. More recently, she has become interested in exploring transdisciplinary knowledge practices relating to environmental change through, for example, exploring arts-based sustainability approaches and how they can contribute to the creation of inclusive urban visions.</p>

<p>The Conference will also highlight examples of good practices from six pilot regions in Belarus, France, Germany, Poland, Serbia and Spain that combine co-creation processes with climate change adaptation and mitigation strategies. Participants will learn from good practice examples and discuss with international experts.</p>

<h4><strong>What is TeRRIFICA?</strong></h4>
<p>The EU funded project TeRRIFICA (Territorial Responsible Research and Innovation Fostering Innovative Climate Action) with its network partners in six regions of Europe will seek for best practice and identify the approaches that are already in place to mitigate climate change and adapt to its effects.</p>
<p>In a trans-disciplinary partnership, TeRRIFICA involves six European countries, bringing together three research institutions, three non-profit organisations, one public association of universities and one public institution for science promotion. TeRRIFICA is led by WILA Bonn (Bonn, Germany) and the TeRRIFICA consortium is composted by the Rhine-Waal University (Kleve, Germany), the Education for Sustainable Development Association (Minsk, Belarus), the Center for the Promotion of Science (Belgrade, Serbia), the University of Vechta (Germany), the Adam Mickiewicz University (Poznan, Poland), Sciences Citoyennes (Paris, France) and the Catalan Association of Public Universities (Barcelona, Spain). The project is funded by the Horizon 2020 programme of the European Commission.</p>
